The CBb has accepted VodafoneZiggo’s appeal and annulled ACM’s WFA decision. The court disagrees with fundamental elements of ACM’s analysis. As a result, the cable access obligation is off the table.

Reaction of VodafoneZiggo: “We are very pleased with the CBb verdict. We have always believed that the broadband market in the Netherlands is highly competitive. Network competition in the Dutch market has led to attractive packages against competitive pricing. ACM was putting this well-functioning market at risk without any justification. This verdict allows us to continue to focus on building the GigaNet network of the future and innovative products and services to keep our frontrunner position in Europe.“
